Receiving a resolution denying your pension is disheartening, especially after years of work and contributions. But a denial does not always mean you have no right to it: it often stems from errors in the week count, a poorly recorded employment history, or a debatable interpretation. Before resigning yourself, know your options.
First step: understand why it was denied
Every denial is notified through an administrative act (a resolution) that must explain its reasons. Read it carefully or take it to a lawyer: missing weeks is not the same as the fund failing to count periods you actually contributed. The exact ground for denial defines the strategy.

Review and correct your employment history
One of the most frequent causes of denial is weeks not reported or incorrectly recorded by former employers. Request your employment history and compare it with your own records: contracts, pay stubs, certifications. If you find missing periods, you can request their correction by providing the evidence. Correcting the employment history is sometimes enough to reach the required weeks.
The remedies: reconsideration and appeal
Administrative remedies are available against the resolution denying the pension — reposición (reconsideration) and, where applicable, apelación (appeal) — which must be filed within the legal deadlines (generally, a few business days from notification). This is the moment to challenge the count, submit evidence and explain why the decision is wrong. Letting these deadlines expire closes doors; act in time.
When the administrative route is not enough
If you exhausted the remedies and the denial unjustifiably persists, you can turn to the ordinary labor courts for a judge to recognize your right. And in cases where the basic subsistence of a person under special protection is at stake (an older adult, a person with a disability), the acción de tutela (constitutional protection action) may exceptionally apply to protect fundamental rights.
Don't let time run out
The right to a pension, as such, does not expire; but the monthly payments can be affected by the statute of limitations if you delay your claim. The longer you wait, the more you may lose. Claiming in time protects both your right and the accumulated money.
